Discretional power of the governor in india

India is the world largest democracy with a parliamentary from of the government . Governor of the states has to play very important role in the federal structure of the nation . He is the nominal executive as well as head of the state.Governor has a discretional power from the Article 163 of the indian constitution. It has say that council of ministers headed by the chief minister to aid and advise the governor, except his discretion . These power of the governor does not inquire into any court . It is a final . governor used his power in the constitutional and situational case :

 Situational discretion :

1. Whene no any political party has a clear -cut majority in the state assembly election at that time governor use situational discretion.
2.If the council of ministers can not prove the confidence in the state legislative assembly in that case governor role as a discretion.
3.If the concil of minister lost its majority , in that case governor can dissol state legislative assembly.

 Constitutional discretion:

1.Recommendation for the presiden't Rule in the state.
2.Reservation of a bill for the consideration of the president.
3.Determining the amount payable by the government of tripura , Assam, meghalaya and mizoram to an autonomous Tribal District council for mineral exploration .
4. Governor can seeking information from the chief minister regarding to the administrative and legislative matter of the state.
